O R D E R

This writ petition has been filed seeking issuance of a Writ of Mandamus, directing respondents 2 and 3 to cancel Patta No.1660 standing in the names of respondents 4 to 8, pertaining to Survey No. 405/4A situated at 07 Mangulam Bit-II, Madurai East Taluk, Madurai District and consequently to issue patta in favour of the petitioner based on his representation dated 27.10.2025 submitted to respondents 1 to 3. 2/6

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the official respondents.

The petitioner claims that his grandfather, Periyalaponna Pillai, purchased 151⁄2 cents of land on the northern side, while one Karuppaiah Pillai purchased another 151⁄2 cents on the southern side. He further submits that he is the sole legal heir to his grandfather's portion of the property. However, the five legal heirs of Karuppaiah Pillai have allegedly obtained Patta No.1660 for the entire extent of 31 cents, though they are entitled only to 151⁄2 cents. In this regard, the petitioner submitted a representation dated 27.10.2025 seeking cancellation of Patta No.1660 and issuance of patta in his favour. As no action has been taken, the present writ petition has been filed.

Learned Additional Government Pleader appearing on behalf of respondents 1 to 3, 4 submits that the petitioner has impleaded the Revenue Divisional Officer as the 9th respondent and that the Revenue Divisional Officer will consider and dispose of the petitioner's representation dated 27.10.2025, in accordance with law. 3/6

In view of the above submission, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the Revenue Divisional Officer/9th respondent to consider the petitioner's representation dated 27.10.2025 on merits and in accordance with law and pass appropriate orders, within a period of twelve weeks from the date of receipt of a copy of this order.

6. Such representation shall be considered and disposed of after conducting an inquiry and affording a reasonable opportunity to the petitioner, respondents 4 to 8 and to all other persons who may be affected by such decision during the course of the inquiry. In the event of any issues pertaining to land disputes, the parties shall approach the competent civil court. No costs.
