(R8 impleaded vide order of this Court dated 11.12.2025) PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondents 2 and 3 to cancel the patta vide No.1110 of the respondents 4 to 7 comprising in Survey No.396/12 situated at 07-Mangulam Bit-II, Madurai East Taluk, Madurai District and consequently to issue patta in favour of the petitioner by considering his representation sent to the respondents 1 to 3 dated 27.10.2025.

O R D E R
This writ petition has been filed seeking issuance of a Writ of Mandamus directing respondents 2 and 3 to cancel Patta No.1110 standing in the names of respondents 4 to 7 in respect of Survey No. 396/12 situated at 07-Mangulam Bit-II, Madurai East Taluk, Madurai District, and consequently to issue patta in favour of the petitioner by considering his representation dated 27.10.2025 submitted to respondents 1 to 3.

2. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the official respondents.
3. The petitioner claims that he is the sole legal heir of the subject property and that he is in possession and enjoyment of the same. However, Patta No.1110 presently stands in the joint names of the petitioner and respondents 4 to 7. The grievance of the petitioner is that respondents 4 to 7 are not entitled to the entire extent of the property. In this regard, the petitioner submitted a representation dated 27.10.2025 seeking cancellation of Patta No.1110 and issuance of patta solely in his favour. As no action has been taken on the said representation, the present writ petition has been filed

Learned Government Advocate appearing on behalf of respondents 1 to 3, 4 submits that the petitioner has impleaded the Revenue Divisional Officer as the 8th respondent and that the Revenue Divisional Officer will consider and dispose of the petitioner's representation dated 27.10.2025, in accordance with law. 3/6

In view of the above submission, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the Revenue Divisional Officer/8th respondent to consider the petitioner's representation dated 27.10.2025 on merits and in accordance with law and pass appropriate orders, within a period of twelve weeks from the date of receipt of a copy of this order.

Such representation shall be considered and disposed of after conducting an inquiry and affording a reasonable opportunity to the petitioner, respondents 4 to 7 and to all other persons who may be affected by such decision during the course of the inquiry. In the event of any issues pertaining to land disputes, the parties shall approach the competent civil court. No costs.
