ORDER

This Writ Petition has been filed to direct the 1st and 2nd respondents to consider the petitioner's representation dated 12.11.2025 and take appropriate action against the private respondents as per the C.S.R.No.453 of 2025 dated 09.10.2025 issued by the 3rd respondent, within the stipulated time fixed by this Court.

2. This writ petition is disposed of at the admission stage, after dispensing with the notice on the private respondents.

3. Heard the learned counsel on either side, and have perused the materials available on record.

4. It is the case of the petitioner that she is the absolute owner in possession of the patta land situated in Survey No.439/3 at Kundrakudi, Sivagangai District. She constructed a compound wall on the said property three months ago. On 09.10.2025, the 3rd to 5th respondents, who are her 2/6

neighbours, came with a hammer, claiming ownership over the land, and demolished her compound wall. When the petitioner attempted to prevent them, they assaulted her with the hammer, pushed her down, and verbally abused her. Thereafter, the petitioner lodged a complaint before the 2nd respondent police on 09.10.2025, for which a receipt in C.S.R.No.435 of 2025 was issued. Despite this, the respondent police neither registered an FIR nor took any action against the accused persons. Consequently, the petitioner submitted a representation dated 12.11.2025 to the 1st respondent, which has also not been considered. Hence, the present petition.

Mr.A.S.Abul Kalaam Azad, learned Government Advocate (Criminal Side), on instructions, submitted that an enquiry has already been conducted in the matter pertaining to C.S.R.No.453 of 2025 dated 09.10.2025 by duly summoning both parties, and the matter has been closed by advising the parties to conduct a survey through the revenue authorities.

Per contra, Mr.Vinodh R., learned counsel for the petitioner, submitted that with regard to the demolition of the compound wall of the petitioner, who is a helpless woman, the version of the learned Government Advocate that the enquiry has been closed by directing the parties to conduct a survey through 3/6

revenue authorities cannot be sustained. The actual issue is not the survey of the land, but the demolition of the compound wall, which constitutes a violation of the petitioner's rights.

In view of the above, the respondent police is directed to consider the petitioner's representation dated 12.11.2025 afresh, by issuing appropriate summons to all the parties concerned and taking necessary action in respect of the said representation, and to conclude the same within a period of two (2) weeks from the date of receipt of a copy of this order.
