ORDER

The petitioner seeks the conduct of a survey in respect of 15 cents in the survey numbers mentioned in the prayer of the writ petition.

2. Learned Special Government Pleader accepts notice for respondents 1 to 4. By referring to earlier order dated 06.01.2023 in W.P(MD)No.390 of 2023 and to order dated 06.07.2023 of the Tahsildar, he points out that the request for survey was rejected for reasons mentioned in the order of the Tahsildar. Consequently, he contends that the present writ petition is not maintainable. 2/5

By order dated 06.01.2023, this court concluded that the application for survey should be relegated to the jurisdictional civil court if the revenue officials find that there is substance in the objections in respect of the request for survey. The Tahsildar concluded that the survey cannot be carried out in view of the disputes relating to title. In those circumstances, the petitioner should challenge the decision of the Tahsildar in accordance with law and cannot reapply for a mandamus.

4. With these observations, this writ petition is disposed of. No costs. 28.11.2025 NCC : Yes/No Index : Yes / No Internet : Yes / No RJR 3/5
