The Civil Miscellaneous Petition has been filed seeking orders to condone the delay of 1327 days in filing the cross objection against the fair and decreetal order, dated 06.03.2019 made in M.C.O.P.No.37 of 2016 on the file of the Motor Accident Claims Tribunal (Additional District and Sessions Judge) Theni.
2.Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the first respondent.
3.The learned counsel appearing for the first respondent would submit that if the petitioners are waiving interest for those periods, they are having no objections to condone the delay.
4.The learned counsel appearing for the petitioners would fairly concede and made an endorsement to that effect.
5.Considering the above, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to number the cros.objection, if it is otherwise in order. The petitioners/claimants are not entitled to interest for the delayed period.
