O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the first respondent to expeditiously dispose of the petition in Na.Ka.No.A6/6375/2025 dated 04.08.2025 within the time stipulated by this Hon'ble Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to the third respondent, as no adverse orders are proposed to be passed against him.

3. The learned counsel appearing for the petitioner would submit that the property in Survey No.108/4A, measuring an extent of 73 cents, situated in Nagachi Group, Ramanathapuram Taluk, is the ancestral property of the petitioner; that the petitioner's father, along with the petitioner's two brothers, without the consent of the petitioner and her other sister, sold the said property to one Ramalingam vide Document No. 312 of 1988, who in turn sold the same to the third respondent vide Document No.638 of 1991; that the sale of the said property is void and Page No. 2 of 5

that the petitioner has been in possession and enjoyment of the said property; that thereafter, the name of the third respondent was also included in the petitioner's Patta No.148; that the third respondent filed a petition dated 26.06.2025 before the first respondent seeking removal of the petitioner's name from the patta, which was taken on file in Na.Ka.No.A6/6375/2025 dated 04.08.2025; and that since the said petition has not been disposed of and the third respondent, taking advantage of the inclusion of his name in the patta, is interfering with the petitioner's possession, the petitioner was constrained to file the present Writ Petition.

The learned Additional Government Pleader appearing for the first and second respondents would submit that the petition filed by the third respondent is pending before the first respondent and that the same would be considered and appropriate orders would be passed after issuing notice to the petitioner, within a period of twelve weeks.

5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to dispose of the petition filed by the third Page No. 3 of 5

respondent on its merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The petition shall be considered and disposed of after conducting an enquiry. The first respondent is also directed to provide a reasonable opportunity during such enquiry to the petitioner, the third respondent and any other interested parties who may be affected by the decision.
