O R D E R

This Writ Petition is filed seeking a direction to the respondents to stop the construction of a toilet which is doing by the respondent No.2 herein at Nalli Sri Singamadai Ayyanar Temple, Situated at Nalli Village, Sattur Taluk, Viruthunagar District.

The grievance of the petitioner is that due to vengeance, the 2nd respondent purposely built a toilet nearby by the petitioner's community land in a hurried manner and there is no proper drainage facility is available at that place. The learned counsel for the petitioner would submit that the pit dumping system is only possible for small number of people usage and in the festival time, there are 5000 families in and around the village will come to the temple. Therefore, permanent toilet facility is not feasible at that place. He further submits that without following the rules and regulations, the second respondent is started to construct the toilet. Therefore, the petitioner has approached this Court for the aforesaid relief.

3. The learned counsel appearing for the 2nd respondent would submit that there is no deviation for construction of the toilet in the subject temple and therefore, prays for dismissal of the Writ Petition. 2/4

4. Considering the facts and circumstances of the case, this Court is of the view that the petitioner is making his private interest as to public interest. Further, since there is no toilet facilities, in order to cater the needs of the public, the 2nd respondent intended to construct the toilet after obtaining necessary planning approval from the authority concerned. If the petitioner wants to provide more facilities, they can construct a separate toilet adjacent to their community hall. If the petitioner feels that there is any violation of construction of the toilet, it is open to the petitioner to approach the authority concerned and make a complaint for taking suitable action. Such being the case, this Court is not inclined to entertain the present Writ Petition and the same is liable to be dismissed.

5. Accordingly, this Writ Petition is dismissed. There shall be no order as to costs.
