ORDER

The petitioner seeks to quash the impugned final report in C.C.No.9 of 2024, on the file of the TNPID Special Court, Madurai District, which was filed for the offences under Sections 406, 420,120(B) of IPC and Section 5 of Tamil Nadu Protection of Interest of Depositors (In Financial Establishment) Act, 1997.

2.When this Court expressed that the point raised by the learned counsel for the petitioner are factual in nature, the learned counsel for the petitioner sought permission of this Court to withdraw this criminal original petition and has made an endorsement to that effect. However, the learned counsel for the petitioner would submit that the petitioner is aged about 58 years and that his personal appearance before the trial Court may be dispensed with.

3. In view of the above submission, this Criminal Original Petition is dismissed as withdrawn. The personal appearance of the petitioner before the Trial Court is dispensed with on all hearing dates (provided he is represented by a lawyer), unless his appearance is required by the 2/4

learned Magistrate for the progress of the trial. Consequently, connected miscellaneous petitions are closed.
