Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the records pertaining to the impugned order made in Ka.No. 05/Employment/2024-2 dated 13.09.2024 on the file of the 2nd respondent and to quash the same as arbitrary and illegal and consequentially direct the respondents to re-instate the petitioner into service and pass such other or further orders as this Honble Court may deem fit and proper in the circumstances of this case and thus render justice. 1/4

ORDER

This writ petition is filed challenging the impugned order made in Ka.No. 05/Employment/2024-2 dated 13.09.2024 on the file of the 2nd respondent and seeking consequential direction to the respondents to reinstate the petitioner into service.

It is to be noted that the petitioner and others caused a revenue loss to the society and committed the offence of misappropriation of society funds, in connection with which a criminal case has been registered against them. It is submitted by the learned counsel for the petitioner that one of the co-accused has filed a writ petition in W.P.(MD) No. 1782 of 2025, challenging his suspension order dated 13.09.2024. This court by an order dated 24.01.2025 in WP(MD).No.1782 of 2025, had directed the 2nd respondent therein to consider the claim of the writ petitioner, in the light of the fact that another co-delinquent has already been reinstated in service, pursuant to the order dated 20.11.2024.

3. It is the petitioner's claim that he may also be reinstated in service; in this regard, the petitioner has made a representation dated 22.02.2025.

4. In view of the same, there shall be a direction to the 2nd respondent to consider the petitioner's representation dated 22.02.2025, in the light of the fact that another co-delinquent has already been reinstated in service on 20.11.2024, and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order.

5. With the above directions, this writ petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
