Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order of the 2nd respondent in Mu.Mu.Aa2/1253/2025 dated 12.05.20235 and confirmed by the impugned order of the 1st respondent in Oo.Mu.C.4/2/63/2025 dated 02.08.2025 quash the same and consequently forbearing the 4th respondent or any one from interfering with the petitioner's peaceful possession and enjoyment of the property covered under the registered deed of settlement dated 31.12.2019 vide document number 2460/2019 on the file of 3rd respondent.

ORDER

The present writ petition has been filed seeking to quash the order passed by the second respondent herein dated 12.05.2025 wherein the settlement deed executed by the fourth respondent in favour of the writ petitioner has been cancelled.

2. Pending writ petition, the parties were referred for Mediation. In the Mediation, the parties have entered into a settlement wherein his son has agreed to purchase the property from his father on payment of sale consideration of Rs.3,25,000/-, which has been paid through Demand Draft. His father has also agreed that he will not demand any maintenance from his son in view of the receipt of full sale consideration of Rs.3,25,000/-. The settlement agreement is extracted as follows:- "1. Disputes and differences had arisen between the parties hereto and W.P.(MD) No. 34117/2025 in W.M.P(MD) No: 26955/2025 was filed on 21/11/2025 before Madurai Bench of Madras High Court, Madurai.

2. The matter was referred to mediation/conciliation vide an order dated 12.02.2026 passed by The Hon'ble Mr. Justice R. Vijayakumar in W.P.(MD) No. 34117/2025 in W.M.P(MD) No: 26955/2025 before Madurai Bench of Madras High Court.

3. The parties agreed that Mr.C.Ramesh and K.Suresh Kumar would act as their Mediator/Conciliator.

4. Several meeting were held during the process of Mediation/Conciliation on from 17.02.2026 to 24.02.2026 and the parties have with the assistance of the Mediator / Conciliator voluntarily arrived at an amicable solution resolving the above mentioned disputes and differences.

5. The parties hereto confirm and declare that they have voluntarily and of their own free will arrived at this Settlement/Agreement in the presence of the Mediator/ Conciliator.

6. The following settlement has been arrived at between the parties hereto:-

1. Both Parties and their counsels are present.

2. Both parties have agreed for a settlement in Case No. W.P.(MD) No. 34117/2025 in W.M.P(MD) No: 26955/2025.

3. As per settlement terms and conditions, the petitioner has agreed to settle the total amount of Rs.3,25,000/- (Rupees: Three Lakhs Twenty Five Thousand Only) to the 4th respondent by way of DD No:238642 dated 19/2/26 in favour of Mr.G.Ravi on 23.02.2026.

4. The 4th respondent has agreed to execute sale deed in favour of the petitioner R.Dhinesh kumar on 23.02.2026 before Sub Registrar, Kunnur, Viruthunagar Dt, for the house property mentioned in this case.

5. The petitioner shall not pay any maintenance amount of Rs:2000/- ordered by Revenue Divisional Officer, Sivakasi, hereafter since full amount of Rs:3,25,000/-(Rupees: Three Lakhs Twenty Five Thousand Only) was given to the 4th respondent as full and final settlement.

6. Both the parties are agreed to withdraw the cases pending before the lower forum if any.

7. There is no binding on the petitioner if the 4th respondent advance any loan amount from any source.

By signing this Agreement the parties hereto state that they have no further claims or demands against each other with respect to W.P.(MD) No. 34117/2025 in W.M.P(MD) No: 26955/2025 (Case No) and all disputes and differences in this regard have been amicably settled by the parties hereto through the process of Conciliation/Mediation".

3. Pursuant to the settlement, the father has received sale consideration of Rs.3,25,000/- through a Demand Draft and has also executed a registered sale deed in favour of the writ petitioner/Son in Document No.853 of 2026 on 23.02.2026.

4. In view of the above said facts, nothing survives to be adjudicated in the writ petition. The settlement shall form part of the order.

5. With the above said observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is also closed. 25.02.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 4/6
