ORDER
The above writ petition has been filed for the following relief:- "Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to register the name of petitioners daughter R. Renganayagi in the Birth Certificate registered in Registration No.144/2003/38, Sl. No.22118, SZ CAR/4148/06 based on petitioners representation dated 13.11.2025 and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice."
2. The case of the petitioner is that he got married to one Alamelu Mangai and out of the wedlock, a female child namely R.Renganayaki was born on 07.03.2003. The same was also registered vide Registration No. 144/2003/38 dated 10.03.2003. However, her daughter's name was not mentioned for registration of birth as the name giving ceremony was celebrated 12th after her birth. Later, he found that her daughter is an autistic child, who has a mental and intellectual disability of 60%, and therefore, he has enrolled her daughter in a Special School for the mentally challenged namely YMCA situated at Ellis Nagar, Madurai. petitioner's grievance the school management insist him to produce a birth certificate mentioning his daughter's name. Therefore, the petitioner has sent a representation dated 13.11.2025 to the respondents to issue a birth certificate to her daughter mentioning her name as R.Renganayaki. However, the same has not been considered to date and therefore, the petitioner has come before this Court.

The contention of the learned counsel appearing for the respondents is that the application is made beyond the time limit as set out in Section 10 of the Registration of Births and Deaths Act, 1969. As per which the application ought to have been made within a period of 20 years from the date of registration of the birth certificate.
4. However, considering the fact that the child in question is an autistic child, the parents would have been so involved in taking care of the child that this formality of adding the name of the child in the birth certificate may have slipped their mind.

5. In such circumstances, the State could take a more benevolent approach in dealing with the request by acceding to it, since no prejudice is going to be caused to any person. That apart, the petitioner ought to have registered the name latest by 09.03.2023 and the delay is only around two years.

In view of the above and taking note of the fact that the challenge in question suffers from autism, the 1st respondent is directed to consider the representation of the petitioner dated 13.11.2025 sympathetically and pass appropriate orders within a period of four (4) weeks from the date of receipt of a copy of this order.
7. With the above directions, the writ petition stands disposed of. No costs.
