ORDER

The above writ petition has been filed for the following relief:- "Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 3 and 4 to cancel the settlement deed document No 2013 of 2022 dated 22.03.2022 on the file of the 5th respondent based on the petitioners representation dated 29.09.2025, 27.10.2025 and 01.11.2025 given to the respondents 1 to 4 and render justice"

2. Mr.A.Kannan, learned Additional Government Pleader takes notice on behalf of the respondents 1 to 5.

3. By consent of both the parties, the writ petition is taken up for final disposal at the admission stage itself. Since no adverse orders are to be passed against the 6th respondent, notice to the 6th respondent is dispense with.

The case of the petitioner is that originally the petitioner is the owner of the property comprised in S.No.769/1, measuring an extent of 3800 sq.ft., with T.S.No.7/1A situated at Sevalur Village, Manapparai Taluk, Tiruchirappalli District. The petitioner's daughter namely Suganthi got married with one Kumar, who is the 6th respondent herein. Out of love and affection, the petitioner had executed a settlement deed dated 22.03.2022 in favour of his daughter under a registered Document No. 2013 of 2022. While so, the petitioner's daughter had passed away on 22.06.2025. Pursuant to her death, the petitioner had obtained legal heir certificate from the Tahslidar, Karaikudi on 30.07.2025. 3/6

5. At this juncture, the 6th respondent is trying to alienate the subject property and therefore, the petitioner has made a representations dated 29.09.2025 and 27.10.2025 to the respondents 1 and 2. He further made a representations before the 3rd and 4th respondent on 01.11.2025.

That apart, the petitioner being a senior citizen has also made a representation under Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 to cancel the settlement deed dated 22.03.2022 executed in favour of his daughter under a registered Document No.2013 of 2022, however, no action has been taken to date. Aggrieved by the same, the petitioner is before this Court.

7. Mr.A.Kannan, learned Additional Government Pleader appearing for the respondents 1 to 5 would submit that representations submitted by the petitioner dated 29.09.2025, 27.10.2025 and 01.11.2025 will be considered and orders will be passed within the time stipulated by this Court.

In view of the same, without expressing any opinion on the merits of the matter, the respondents 1 to 5 are directed to consider the representation of the petitioner dated 29.09.2025, 27.10.2025 and 01.11.2025 and pass appropriate orders on merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order.

9. The writ petition is disposed of with the above observations. No costs.
