ORDER

This Criminal Original Petition has been filed seeking issuance of a direction to the second respondent to conduct an inquiry and lodge the First Information Report on the basis of the petitioner's online complaint bearing 1/6

Reference No. RAV 25565910 dated 11.11.2025.

Facts of the Case:

2. The petitioner belongs to a village where there exists a customary practice of honouring one among the villagers as "Ambalam-Parivattam". According to the petitioner, on 10.11.2025 at about 10.00 a.m., certain villagers, under the influence and instigation of one Muthu Naachan, attempted to bestow such honour upon Ramasamy @ Selvam, contrary to the longstanding custom.

When the petitioner and her husband questioned the said act, the villagers informed them that five years ago, the petitioner's husband Thirupati had already been honoured as Ambalam in the presence of representatives from 18 villages. However, disregarding this practice and with malafide intention, Muthu Naachan proceeded with the honour in favour of the said Ramasamy alias Selvam.

It is further alleged that during the said incident, Muthu Naachan used abusive language, and he, along with his associates, attacked the petitioner's husband Thirupati and another person, Sathan, using an iron rod. As a result, both sustained injuries. The petitioner's husband suffered a head injury with profuse bleeding, and was immediately admitted to the Thuvarankurichi Government Hospital, Trichy District, where he and 2/6

Sathan underwent inpatient treatment for three days. The Government doctor also issued an intimation to the respondent police regarding the occurrence.

Petitioner's Grievance:

5. Despite the seriousness of the offence, the respondent police failed to register an FIR against the assailants. The petitioner personally approached the second respondent on 11.11.2025 with a written complaint, which was allegedly refused.

6. Left without an alternative, the petitioner submitted an online complaint on 11.11.2025 bearing Reference No. RAV 25565910. However, no enquiry or action has been taken by the second respondent till date. The petitioner alleges that the accused, particularly the said Muthu Naachan, is a politically influential person, and due to such influence the police have chosen not to act.

7. This Court has consistently held that when information discloses commission of a cognizable offence, the police officer concerned is dutybound to register an FIR under Section 154 Cr.P.C., 1973, as reiterated by the Hon'ble Supreme Court in Lalita Kumari v. Government of Uttar Pradesh1.

8. The allegations in the present case clearly disclose commission of cognizable offences. The medical records, hospital intimation and the petitioner's repeated attempts to lodge her complaint demonstrate prima facie material requiring immediate police action. Non-registration of the FIR despite such material cannot be sustained.

9. This Court is of the view that the grievance of the petitioner is genuine and the inaction of the second respondent is wholly unjustified. When a victim approaches the police with a complaint disclosing a serious assault with weapons, the respondent police cannot remain passive.

10. In view of the above, this Court is inclined to allow the petition. Accordingly, the second respondent is directed to conduct an inquiry forthwith on the basis of the petitioner's online complaint bearing Reference No. RAV 25565910 dated 11.11.2025, and, if the information discloses commission of a cognizable offence, to register a First Information Report and proceed with investigation in accordance with law. The above exercise shall be completed within a period of two weeks from the date of receipt of a copy of this order.

11. With the above directions, this Criminal Original Petition is allowed.
