ORDER

Heard both sides.

2.Sale deed dated 10.11.2025 was executed in favour of the writ petitioner. Document was presented for registration. Registration was refused and the petitioner was called upon to obtain "No Objection Certificate" from the jurisdictional Revenue Divisional Officer. Challenging the stand of the registering authority, this writ petition came to be filed.

3.It is seen that the subject property was originally assigned. The original assessee had settled the property in favour of the writ petitioner's vendor vide document dated 25.03.2025 (Document No.3253 of 2025). Subsequently, patta was also mutated in favour of the writ petitioner's vendor.

4.When no exception was taken to registration of the document in favour of the writ petitioner's vendor by the original assignee, there is no reason as to why such an objection should be raised at this point of time. The Hon'ble Division Bench of Madras High Court in the decision reported in (2010) 5 LW 289 (C.Tirumalai Gounder Vs The State of Tamil Nadu) held that when one's property had changed hands and mutation of revenue record has also been effected, the revenue authority cannot thereafter raise any objection.

5.In this view of the matter, the order impugned in this is quashed. The parties are liberty to re-present the document. It shall be registered and released subject to the fulfilment of the other usual formalities. 3/5
