O R D E R
There is a dispute as to whether the land in which electrical poles are proposed to be erected for providing service connection to the petitioner's dwelling house is a cart track belonging to the State Government. In view of the same, the Tahsildar, Vedasandur Taluk, Dindigul District, is suo motu impleaded as the 11th respondent. Mr. S. Kameswaran, learned Government Advocate, takes notice for the 11th 2/6
respondent.

The petitioner is before this Court seeking issuance of a writ of mandamus directing respondents 1 to 3 to provide electricity service connection to his dwelling house bearing Door No. 7/69, situated in Survey No. 220/3B, Nathappatti Village, Dindigul District, without insisting upon a No Objection Certificate from respondents 4 to 7.
3. The petitioner had submitted an application seeking electricity service connection to his dwelling house. However, the said application has not been considered by respondents 1 and 2 on the ground that the private respondents have objected to the erection of electricity poles, contending that the land in question is a cart track and that such erection would obstruct their free movement.
4. Electricity service connection is a basic amenity, and the petitioner cannot be deprived of the same. In order to resolve the controversy, this writ petition is disposed of with the following directions:

(i) The 11th respondent shall conduct a survey of the land in Survey No. 220/4, situated at Nathappatti Village, Vedasandur Taluk, Dindigul District, to ascertain whether the said land is a cart track belonging to the State Government.
(ii) The survey shall be conducted in the presence of the petitioner, respondents 1 to 3, and the private respondents, after issuing due notice to all concerned.
(iii) The cost of the survey shall be borne by the petitioner. (iv) The 11th respondent shall complete the survey within a period of six (6) weeks from the date of receipt of a copy of this order and shall submit a report enclosing a sketch of the land in question. (v) Upon receipt of the survey report, if it is found that the land is a cart track belonging to the State Government, respondents 1 to 3 shall erect the necessary electricity poles in such a manner so as not to obstruct the free movement of the public and provide electricity service connection to the petitioner's dwelling house within a period of two (2) weeks thereafter.

5. There shall be no order as to costs.
