O R D E R

The petitioners assert that they are the owners of paddy shop No.D.150, which is situated in the Madurai Sales Committee complex. In relation thereto, it is stated that the petitioners made excess payments towards principal and compound interest. By relying on the judgment of the Hon'ble Division Bench of this Court in W.A.(MD) No.1393 of 2011, dated 28.09.2022 in the Madurai Paddy Commission vs. The Commissioner, Department of Agricultural Marketing and Agri Business and another, learned counsel submits that this Court held that only the principal with simple interest thereon at 16% p.a. should be collected. Contrary to the said judgment, he submits that a larger amount, including compound interest, was collected from the petitioner. Therefore, learned counsel submits that the petitioners are entitled to a refund of such excess amount.

2. Learned Government Advocate accepts notice for the respondent. He has handed over an affidavit affirmed by the petitioners 2/4

on 20.04.2021 to the effect that they are agreeing to pay the outstanding amount with interest and that they will not seek the benefit of the order in W.A.(MD) No.1393 of 2011. Without prejudice, learned counsel submits that the respondent would consider and dispose of the representation on merits.

In the above facts and circumstances, without expressing any opinion on the merits, this Writ Petition is disposed of by directing the respondent to consider and dispose of petitioners' request for refund on merits within three (3) months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner. No costs. W.M.P.(MD) No.27377 of 2025 is allowed.
