ORDER
(Order of the Court was made by G.K.ILANTHIRAIYAN, J.) This Habeas Corpus Petition is filed to direct the respondents 1 and 2 to produce the body or person of the detenu, namely, Harshinee D/o.Perumal, aged about 19 years before this Court and set her at liberty.
2. The petitioner is the mother of the detenu who is aged about 19 years. She was missing from her residence from 17.11.2025 onwards. Therefore, she lodged a complaint before the second respondent police and the same has been registered in Crime No.677 of 2025 under the caption "girl missing". However, the second respondent police did not proceed with the investigation and as such the petitioner was constrained to approach this Court by way of this Habeas Corpus Petition.
3. While pending Habeas Corpus Petition, the second respondent conducted an enquiry and found the whereabouts of the 2/5
detenu and produced before this Court.
4. Today, both the petitioner along with her husband and the detenu appeared before this Court.
5. The detenu deposed before this Court that on her own volition she went to her friends house due to some misunderstanding between the detenu and her parents. Now also she is not in a position to stay with her parents. She wants to stay with her friends house. In fact she stated that she also came before this Court along with her friend and she is standing outside the Court campus, since she was not allowed to enter into the Court without pass.
5. This Court also examined the petitioner and her husband. Thought they have stated so many reasons for the detenu to stay outside, the detenu is aged about 19 years and expressed her unwillingness to stay with the petitioner, since she is a major she can take her decision on her own.
6. Further, the detenu also deposed that she does not want to go with her parents and she seeks further time to console herself, till such 3/5
time she wants to stay at her friends house.
7. Therefore, this Court cannot compel the detenu who attained the age of majority to stay with her parents or anywhere. This Court also found that the detenu is not in any illegal custody of anyone.
8. In view of the above, this Habeas Corpus Petition is devoid of merits and dismissed.
