PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to impugned order dated 14.11.2025 issued by the second respondent pursuant to premises bearing T.S.No 423 with D.No.136A, 136A/2 and 136A/3 situate at T.S.Ward 7, Block 2, Cheranmahadevi Road, Tirunelveli Town and Corporation, and quash the same and consequently direct the second respondent to grant further period of eight weeks to the petitioner to remove all his movables completely and for demolishing the unauthorized portion by himself after the revised plan is considered by considering the petitioner's representation dated 22.11.2025.

ORDER
(Order of the Court was made by R. POORNIMA, J.) This Writ Petition has been filed praying to issue a Writ of Certiorarified Mandamus, to quash the impugned order dated 14.11.2025 issued by the second respondent in respect of the premises bearing 2/6
T.S.No 423 with D.No.136A, 136A/2 and 136A/3 situate at T.S.Ward 7, Block 2, Cheranmahadevi Road, Tirunelveli Town and Corporation and consequently directing the second respondent to grant a further period of eight weeks to the petitioner to remove all his movables completely and to demolish the unauthorized portion by himself after the revised plan is considered.
2.Mr.S.P.Maharajan, learned Standing Counsel for the second respondent, states that already an order dated 23.06.2025 has already been issued by the Additional Secretary, specifically directing the petitioner to obtain a demolition approved plan from the Tirunelveli Municipal Corporation showing the rectification, if any proposed, to bring the construction in conformity with the current rules in force, and to submit a structural stability report to the Tirunelveli Municipal Corporation. He further submits that the building had already been sealed and thereafter de-sealed, but till date, the petitioner has not taken any steps to remove the unauthorised construcion. 3/6
3.The learned standing counsel for the second respondent further submits that a notice for lock and seal has been issued today (27.11.2025) to be executed by 04.00 pm.
4.At this juncture, learned counsel appearing for the petitioner submits that the petitioner will not be in a position to remove all his belongings within a single day.
5.In view of the above, liberty is granted to the petitioner to remove all his belongings tomorrow (28.11.2025) by 10.00 a.m., failing which the authorities shall proceed in accordance with law. 6.Accordingly, this Writ Petition is dismissed.
