ORDER : The Court made the following order :- This petition has been filed to modify the condition, ie., to surrender the passport of the petitioner, imposed in the order made in Crl.M.P.No. 2673 of 2025, on the file of the Principal Sessions Judge, Sivagangai dated 05.11.2025.

2. Heard the learned counsel on both sides and perused the materials available on record.

3. The learned counsel for the petitioner submitted that one of the condition in Clause 5 is to surrender the passport. Hence, he seeks modification of the said condition.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that if the petitioner is allowed to get passport, he will not appear for the three cases which were pending against the petitioner and hence, he vehemently opposed for modification of the said condition. 2/6

5. The learned counsel for the petitioner submitted that he is having work for a period of nine months and unless he allowed to get his passport, he cannot comply his term of work in abroad.

6. Considering the fact that the petitioner is having only a few months to complete the work permit, this Court is inclined to modify the order of the lower Court. Hence, the respondent is directed to return the passport to the petitioner. However, the petitioner is strictly directed to surrender the passport after his work permit is completed in abroad.

7. The petitioner shall report before the Principal Sessions Court, Sivagangai, by the last week of November, 2026 and also surrender his passport. In case, if the trial is fixed and any notice is received by the petitioner, he shall participate in the trial proceedings without fail. 3/6

8. With the above modification and directions, this Criminal Original Petition is ordered.
