Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the respondents 1 and 2 to provide police protection to the life and limb of the petitioner by considering the petitioner's representation dated 17.10.2025.
ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents 1 and 2 to provide police protection to the life and limb of the petitioner by considering the petitioner's representation dated 17.10.2025. 2.Admittedly, there is a civil dispute between the petitioner and the 3rd respondent. The third respondent is alleged to have purchased some of the lands and the petitioner is residing in the said place.
3.However, the learned Counsel appearing for the petitioner submitted that the third respondent has not purchased the land and he his encroaching the land by evicting the other persons also. 53 families have been evicted forcefully by encroaching the lands. The petitioner and others have filed a petition to issue patta. But the 3rd respondent submitted that he has purchased it from one Vasantha W/o. MVP.Dhayalvel. 4.Admittedly, there is a rival dispute and there is a suit pending for eviction to evict the petitioner. In such circumstances, the third respondent cannot seek police assistance to evict the petitioner.
5.Therefore, this Court is restraining the respondents from evicting the petitioner and also the parties in the suit before the disposal of the suit. If there is any such forceful eviction with the assistance of police, the same would amount to contempt of Court.
WP Crl.(MD) NO. 2300 of 2025 6.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
