O R D E R
[Order of the Court was made by N.SATHISH KUMAR, J.] This petition is filed seeking to condone the delay of 348 days in filing the above writ appeal.
2.Heard Mr.A.Shajahan, learned counsel appearing for the petitioner, Mr.R.Alagumani, learned counsel appearing for the first respondent and Mr.S.P.Maharajan, learned Special Government Pleader appearing for the respondents 2 and 3.
3.Though the learned counsel appearing for the first respondent sought time to file a counter affidavit, taking note of the fact that the petitioner/Insurance Company was not served with notice at the time of passing the order in W.P(MD)No.897 of 2018 dated 11.11.2024, and that the 1/3
said order was passed ex parte and came to be served only at the stage of implementation, this Court is inclined to allow the petition. 4.Accordingly, the delay is condoned and the petition stands ordered.
