ORDER

An enquiry notice dated 11.11.2025 from the Tahsildar in relation to a request for cancellation of the patta is challenged in this writ petition primarily on the ground of lack of jurisdiction.

2. Learned Additional Government Pleader accepts notice for first respondent and Mr.R.G.Shankar Ganesh, learned counsel, accepts notice for second respondent.

3. In an earlier order dated 16.09.2025 in W.P(MD)No.25203 of 2025, I directed the Revenue Divisional Officer to consider the representation of the petitioner therein and dispose of the same after conducting an inquiry and providing a reasonable opportunity to the 3rd respondent therein. The Tahsildar is not empowered to cancel a patta issued earlier and is only empowered to consider a request for transfer of patta based on events subsequent to the issuance of the earlier patta. In these circumstances, impugned notice cannot be sustained and is hereby quashed. However, it is clarified that it is open to the Revenue Divisional Officer to issue notice and conduct an inquiry as per the earlier order of this court. It is also open to the Tashildar to submit a report in relation to such inquiry to the Revenue Divisional Officer. 2/4

4. This writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are also closed.
