PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st Respondent to issue the Passport to the Petitioner in application in File No.MD2065638052825 on the file of the 1st Respondent based on his representation dated 11.11.2025. ORDER

The present writ petition has been filed seeking a mandamus as against the first respondent to issue the passport based upon his application dated 11.11.2025.

2. The learned Government Advocate(crl.side) appearing for the second respondent brought to the notice of the Court that a criminal case is pending as against the petitioner in Cr.No.64 of 2023 on the file of the second respondent. However, so far, charge sheet has not been laid. He also brought to the notice of the Court that when the occurrence has taken place, the petitioner was juvenile and the case has been split up and referred to juvenile board.

3. This Court in a judgment reported in 2014 8 MLJ 61 has held that mere pendency of FIR would not be a legal impediment for issuance of passport.

4. In view of the above said facts, the first respondent is directed to consider the application of the petitioner and pass orders within a period of four weeks from the date of receipt of a copy of this order.

5. With the above said observations, this writ petition stands disposed of. No costs.
