ORDER

(Order of the Court was made by DR.G.JAYACHANDRAN, J.) The petitioner, who is the holder of patta in Survey No.906/5 in Malaikudipatti Village, Thirumayam Taluk, Pudukottai District, is before this Court stating that the eviction notice issued by the Block Development Officer dated 06.11.2025 to evict him from Survey No. 906/5 is not legally sustainable on the ground that the competent authority to issue eviction is only the Tahilsdar and not the Block Development Officer. That apart the appellant claims that he holds patta for the subject land and he cannot be termed as encroacher. 2.The learned Additional Government Pleader submits that the petitioner holds patta in respect of the property in Survey No.907/2, whereas Survey No.906/5 is classified as Arasu Poromboke lake and they are occupying the Government poromboke land illegally.

Hence, notice under Section 131 (2) of the Tamil Nadu Panchayat Act was issued by the Block Development Officer requesting them to vacate the encroached portion, if they fail to do so, then necessary action will be taken for eviction by the Tahsildar under Section 7 of the Land Encroachment Act.
