PRAYER: This Petition is filed under Order 41 Rule 19 of CPC., to set aside the order, dated 25.10.2025 in C.M.A(MD)No.801 of 2010 on the file of this Court and restore the same.
ORDER
This petition has been filed to restore the C.M.A(MD)No.801 of 2010, which was dismissed for default on 25.10.2025.
2. Heard the learned counsel for the petitioner. The learned Government Advocate for the respondents has not raised any objection to allow this petition.
3. I have perused the affidavit filed in support of this application and being satisfied with the reasons stated in the affidavit, this Court is inclined to allow this petition. Accordingly, this petition is allowed.
4. Registry is directed to restore the C.M.A(MD)No.801 of 2010 and list the matter after two weeks.
