ORDER

The above writ petition has been filed for the following relief:- "Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus call for the records pertaining to the impugned letter in Ref.No. SCN/1049839193/25 dated 13.08.2025 on the file of 1st respondent to quash the same as unconstitutional and consequently direct the 1st respondent to issue passport to the petitioner by scrutinizing petitioners application File No. MDA065377550825 dated 23.07.2025 in accordance with law, within time stipulated by this Honble Court and pass such other or further orders as this Honble Court may deem fit and proper in the circumstances of this case and thus render justice."

2. Mr.G.Vishnuram, learned Central Government Standing Counsel takes notice on behalf of the 1st respondent. Mr.S.Prakash, learned Government Advocate takes notice on behalf of the 2nd respondent. 2/6

3. By consent of both the parties, the writ petition is taken up for final disposal at the admission stage itself.

4. The brief facts of the case as set out in the affidavit filed in support of the writ petition are as follows:- The petitioner would submit that he had applied for passport on 23.07.2025. By a letter dated 13.08.2025, he was directed to give an explanation with respect to the criminal case pending against him in Crime No.305 of 2022, for the alleged offences under Sections 143, 268 of IPC (Under Sections 189(2), 270 of BNS).

5. He would submit that in the year 2022 about 44 persons had protested against the State Government and therefore, the 2nd respondent police had suo-moto registered FIR against the said 44 persons including the name of the petitioner, who was in no way connected to the said protest.

6. He would further submit that he has been falsely implicated in the case in Crime No.305 of 2022 and the same is pending against him. Therefore, the petitioner has filed the present writ petition.

7. Heard the learned counsel on either side.

8. Considering the fact that the offences alleged are not of a very serious issue affecting national security, the impugned letter passed by the 1st respondent dated 13.08.2025 is set aside and the 1st respondent is directed to issue passport to the petitioner within a period of three (3) weeks from the date of receipt of a copy of this order.

9. With the above directions, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed. 28.11.2025 NCC :yes/No Index :yes/No 4/6
