ORDER

This Writ Petition has been filed to direct the 2nd respondent to take appropriate action to conclude the enquiry of the petitioner's complaint referring complaint No.SP/G3/4299/31618/2024 dated 29.11.2024 by following the due process of law within the time stipulated by this Court.

2. Heard the learned counsel on either side, and perused the materials available on record.

3. It is the case of the petitioner that he was introduced to one Elango in the year 2023, who claimed to be an assistant to one Ganthirajan, M.L.A., from the Vedasandur constituency. The said Elango informed the petitioner that he could arrange a government job for him, particularly in the Collectorate or in the District Courts, for which he demanded a sum of Rs.7,00,000/- from the petitioner. Believing his words, the petitioner arranged the said amount and paid the same to the said Elango on various dates through bank transactions and cash payments. Despite having received the said amount, the said Elango cheated the petitioner by neither securing a government job nor returning the money.

4. Aggrieved by the said incident, the petitioner lodged a complaint before the 1st respondent on 29.11.2024, which was forwarded to the 2nd respondent. Upon enquiries conducted by the 2nd respondent on 14.12.2024 and 01.02.2025, the said Elango admitted that he had received the payments from the petitioner in various instalments. Even thereafter, no further action has been taken by the respondents. Hence, the present petition.

5. Mr.S.S.Manoj, learned Government Advocate (Criminal Side), on instructions, submitted that the enquiry had already been conducted and closed on 10.07.2025.

Per contra, M/s.M.Viji, learned counsel for the petitioner, submitted that during the course of the enquiry itself, the accused had admitted receipt of the amount from the petitioner and that the respondent police, without any intimation to the petitioner, closed the enquiry by treating the issue as a money dispute.

7. In view of the above, the 2nd respondent police is directed to reopen the enquiry, redo the exercise, and conclude the same in the manner known to law 3/5

by taking appropriate action within a period of two (2) weeks from the date of receipt of a copy of this order.
