Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the Respondent No.1 to dispose the appeal filed by the Petitioner dated 10.11.2025 and consequently, direct the Respondents No.1 to cancel the pattas in Patta No.1710 and 897 in respect of land in Survey No.489/1 and 465 in Sethur Village, Natham Taluk, Dindigul District which stands in favor of Respondents No.3 and 4 respectively and provide patta to the petitioner for the same within the time stipulated by this Court. O R D E R
By asserting that the petitioners are the owners of land in survey Nos.489/1 and 465 at Sethur village and that patta Nos.1710 and 897 were wrongly issued in the names of the third and fourth respondents, the petitioners had filed an appeal before the Revenue Divisional Officer. Early disposal of such appeal is requested for in this Writ Petition. 2/5
2. Learned Government Advocate accepts notice for respondents 1, 2 and 5. He submits that the Revenue Divisional Officer would consider the appeal and dispose of the same on merits after providing a reasonable opportunity to the petitioners and the pattadar.
3. In view of the said submission, it is not necessary to issue notice to the third and fourth respondents in this Writ Petition. Instead, without making any observations on the merits, this Writ Petition is disposed of by directing the Revenue Divisional Officer to consider and dispose of the pending appeal on merits within three (3) months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioners and the pattadar. No costs. W.M.P.(MD) No.27131 of 2025 is allowed.
