ORDER
This Writ Petition has been filed to direct the 2nd respondent to conduct investigation on the complaint given by the petitioner by acting upon the proceedings of the 1st respondent dated 14.11.2025.
2. This writ petition is disposed of at the admission stage, after dispensing with the notice on the private respondents.

It is the case of the petitioner that he has been carrying on a construction business along with the 3rd respondent and one of the shareholders under the name and style of "MLC Projects & Infra Private Limited (Specialization in Roads & Infra)" for more than two years. Due to malafide intentions and in a conspiracy, the 3rd and 4th respondents misused the company's bank accounts and withdrew a sum of Rs.1,70,00,000/- between 15.10.2025 and 24.10.2025.
4. In this regard, a complaint dated 14.11.2025 was submitted before the 1st respondent. The said complaint was acknowledged by the 1st respondent and communicated to the 2nd respondent with a direction to take action within fifteen days. Despite the same, no action has been taken till date. Hence, the present petition.

5. Heard the learned counsel on either side, and have perused the materials available on record.

It is needless to point out that whenever a complaint of this nature is made to a Statutory Authority, there is a duty cast upon the respondent to consider the same on its own merits and pass appropriate orders in one way or other instead of keeping the same pending indefinitely. As such, nonconsideration of the complaint made by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking the extraordinary powers under Article 226 of the Constitution of India.
7. Without going into the merits of this case, this Court hereby direct the 2nd respondent Police to consider the petitioner's complaint dated 14.11.2025 and deal with in accordance with law and conclude the enquiry within a period of two (2) weeks from the date of receipt of a copy of this order.
