Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the first and second Respondents to survey, demarcate and determine the boundary of petitioner's house site plot land in Old Survey No.268 and New Town Survey No.9/28 total extent 5 cents (2180 square feet) which is situated at Chinnamanur Town, Uthamapalayam Taluk, Theni District, based on petitioner's Application No.2025/0178/25/000098 dated 18.11.2025 and permit the petitioner to video graph the entire survey proceedings and consequently, direct the third respondent to give a police protection at the time of the survey above said property within a specific period as fixed by this Court.

O R D E R

By relying on a sale deed dated 09.10.1998 and the extract from the Town Survey Land Register, the petitioner had applied for a survey of Town Survey No.9/28 of the extent of 2 ares. The present Writ Petition relates thereto.

2. Learned Additional Government Pleader accepts notice for respondents 1 and 2 and learned Government Advocate (Crl.Side) accepts notice for the third respondent.

3. The petitioner has placed on record both title and revenue records relating to the property. Therefore, a case is made out to consider the petitioner's request.

Accordingly, the first and second respondents are directed to initiate action on the petitioner's request for a survey after issuing notice to owners of relevant adjacent lands and considering objections, if any, from them. For the avoidance of doubt, it is clarified that the survey shall not be conducted if there is a credible title dispute, whereas boundary disputes may be decided by the official respondents. The entire process shall be concluded within three (3) months from the date of receipt of a copy of this order. If the revenue officials consider it necessary, they may avail of the assistance of the jurisdictional police.
