ORDER : The Court made the following order :- 1/5
The petitioner, who was arrested and remanded to judicial custody on 15.09.2025 for the offences punishable under Sections 103(1), 126(2), 49, 61(2) (a) of BNS, and corresponding Section 302, 341, 109, 120B of IPC, in Crime No.802 of 2025, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the defacto complainant is the wife of the deceased Rajkumar. On 12.09.2025 at 08.00 p.m, the deceased while returning home in his two wheeler and coming near the junction of 1st and 2nd street at Park Town, Madurai, the accused persons armed with knife wrongfully restrained the deceased and assaulted him brutally and caused injuries all over his body due to which, he died on the spot. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is in judicial custody from 15.09.2025. 2/5
Hence, he seeks bail to the petitioner.
4. The learned Government Advocate (Criminal Side) submitted that the petitioner/A6 is the master mind of the brutal attack and he has repeatedly called the victim family and threatening the family members. Hence, he opposed for grant of bail to the petitioner.
5. The learned counsel appearing for the intervenor vehemently opposed to grant bail to the petitioner since it is a brutal murder.

Considering the facts and circumstances of the case, and also considering the fact that the petitioner/A6 is the master mind of the brutal attack and he has repeatedly called the victim family and threatening the family members and he is having audacity to do so inspite of he is being in jail. Hence, this Court is of the view that such persons cannot be let out at all. Therefore, this Court is not inclined to grant bail to the petitioner. 3/5
Accordingly, this Criminal Original Petition is dismissed.
