ORDER
This Writ Petition has been filed to direct the 2nd respondent Police to initiate appropriate action on the petitioner's representation dated 14.08.2025 in accordance with law within a stipulated time.
2. It is the case of the petitioner that she is a widow having two daughters. The petitioner's late husband has one brother, namely Veeranan. The said Veeranan fabricated the death certificate and legal heir certificate of the petitioner's husband while he was alive. On the basis of these fabricated certificates, the accused obtained a sale deed from one of the petitioner's daughters, namely Sangeetha, who was shown as the sole legal heir of the petitioner's husband, on 02.01.2024, in respect of the properties belonging to the petitioner's husband.
3. In this regard, the petitioner preferred a complaint before the 1st respondent on 14.08.2025, and the same was forwarded to the 2nd respondent. Before the 2nd respondent could conduct an enquiry, the accused cancelled the bogus sale deeds and informed the police that the sale deeds had already been cancelled. However, the accused is still preventing the petitioner from entering the property and is issuing life threats. Based solely on the statement of the 2/5
accused, the respondent Police has not taken any further action in the matter after the enquiry. Hence, the present petition.
4. Mr.A.S.Abul Kalaam Azad, learned Government Advocate (Criminal Side), on instructions, submitted that the petitioner is not co-operating wih the enquiry.
5. Heard the learned counsel on either side, and have perused the materials available on record.

It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon the respondent to consider the same on its own merits and pass appropriate orders in one way or other instead of keeping the same pending indefinitely. As such, nonconsideration of the representation made by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking the extraordinary powers under Article 226 of the Constitution of India.
7. Without going into the merits of this case, this Court hereby direct the 2nd respondent to take appropriate action on the petitioner's representation dated 3/5
14.08.2025 and deal with in accordance with law and conclude the enquiry within a period of two (2) weeks from the date of receipt of a copy of this order. The petitioner is also directed to co-operate with the enquiry to be conducted by the 2nd respondent police.
