PRAYER :- This Petition is filed under Section 528 BNSS, to call for the records pertaining to the First Information Report in Crime No.391 of 2025, dated 26.10.2025 on the file of the first respondent Police and quash the same as against the petitioners.

ORDER

This Criminal Original Petition is filed seeking to quash the First Information Report in Crime No.391 of 2025, dated 26.10.2025, on the file of the first respondent Police, which was registered for the offences under Sections 191(2), 296(b) and 115(2) of BNS, 2023.

2. The gist of the allegations is that on 20.10.2025, at about 08.00 p.m., the defacto complainant along with other persons busted crackers. At that time, the petitioners came to the occurrence place, throw the beer bottle, abused him in filthy language and also attacked him with wooden log and threatened him with dire consequences. Hence, the present complaint.

3. The learned counsel appearing for the petitioners and the learned counsel appearing for the third respondent submitted that they have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo dated 11.12.2025.

4. The petitioners and the third respondent are present before this Court in person. They are identified by Mr.C.Jothimani, SSI, VShanarpatti Police Station, Dindigul District. The defacto complainant does not wish to pursue the said F.I.R as against the petitioners. All the parties confirmed the compromise arrived at between them. 5.Considering the nature of the allegations and the relationship between the parties, this Court is of the view that no useful purpose would be served by keeping the impugned FIR pending investigation. Accordingly, the impugned FIR in Crime No.391 of 2025 is quashed in entirety and the Criminal Original Petition stands allowed. Each of the petitioners shall deposit a sum of Rs.1,000/-(Rupees Thousand only) for 3/6

establishing an E-Library to the credit of the MBHAA, in Indian Bank, Madurai Bench of Madras High Court Branch, Account No.496038755 IFSC No.IDIB000H040, MICR Code: 625019020, within a period of one week from today. The joint compromise memo dated 11.12.2025 shall form part and parcel of this order. Consequently, the connected criminal miscellaneous petition is closed.
