Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the first and second respondents to survey the petitioner's property in S.No. 173/9A to an extend of 0-4.75 Hector, respectively, situated at Periyakottai Village, Karaikkudi Taluk, Sivagangai District and to install the boundaries stones as per revenue records by obtaining adequate police protection from the third respondent police within the period that may be stipulated by this Court.

O R D E R
By relying on a settlement deed dated 17.02.2025 and a separate patta No.2263, the petitioner had applied online for a survey of 4.75 ares in survey No.173/9A. The present Writ Petition relates thereto.
2. Learned Government Advocate accepts notice for respondents 1 and 2 and learned Government Advocate (Crl.Side) accepts notice for the third respondent. The petitioner has submitted both title and revenue records relating to the property. Therefore, a case is made out to consider the petitioner's request.
3. Accordingly, the first and second respondents are directed to initiate action on the petitioner's request for a survey after issuing notice to owners of relevant adjacent lands and considering objections, if any, from them. For the avoidance of doubt, it is clarified that the first and 2/4
second respondents shall not carry out the survey if there is a credible title dispute, whereas boundary disputes may be decided by them. The entire process shall be concluded within three (3) months from the date of receipt of a copy of this order. If considered necessary by the revenue officials, they may avail of the assistance from the jurisdictional police.
