PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to compute and pay the petitioner difference amounts in the benefits in respect of Gratuity, Encashment of Leave Salary, Family Pension by taking revised Dearness Allowance i.e. on par with serving employees of Transport Corporation with Arrears from the date of death of her husband i.e.10.09.2023 in terms of the 15th wage revision settlement entered under section 12(3) of I.D Act dated 25.08.2025 together with interest at the rate of 6% per annum for the differential payment to be computed from the date of death of her husband till the date of payment within a time frame as may be fixed by this Court. ORDER

The present Writ Petition has been filed for a writ of Mandamus to direct the respondents to compute and pay the petitioner difference amounts in the benefits in respect of Gratuity, Encashment of Leave Salary, Family Pension by 2/5

taking revised Dearness Allowance i.e. on par with serving employees of Transport Corporation with Arrears from the date of death of her husband i.e. 10.09.2023 in terms of the 15th wage revision settlement entered under section 12(3) of I.D Act dated 25.08.2025 together with interest at the rate of 6% per annum for the differential payment to be computed from the date of death of her husband till the date of payment within a time frame as may be fixed by this Court.

2.The learned counsel for the petitioner submits that the issue raised in this writ petition is covered by an earlier order passed by this Court and has placed reliance on the order made in W.P(MD)No.20522 of 2025 dated 29.07.2025.

3. The learned Standing Counsel for the respondents also does not dispute the said fact.

4. In view of the same, the respondents are directed to release the eligible benefits to the petitioner together with 6% interest from the due date till the date 3/5

of disbursement, within a period of 12 weeks from the date of receipt of a copy of this order.
