ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the first respondent to consider and dispose of the petitioner's statutory appeal dated 06.11.2025, relating to the request for change of classification of land in Survey No.428/2, Karadikal Village, within a time frame to be fixed by this Court, and consequently, directing the respondents 2 and 3 not to take any action in respect of Survey Nos.428/1 and 428/2, Karadikal Village, until the disposal of the said appeal by the first respondent.

2. With the consent of the parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3. According to the petitioner, he filed an appeal dated 06.11.2025, requesting to change the classification of land in Survey No.428/2, Karadikal Village before the first respondent and the said appeal is pending.

4. The learned counsel for the petitioner submits that there is a likelihood of prejudice, if the respondents 2 and 3 take any action in respect of Survey Nos. 428/1 and 428/2 before the appeal is disposed of. Hence, the present Writ Petition.

5. The learned Special Government Pleader for the respondents submits that a show cause notice dated 17.11.2025 was issued to the petitioner pursuant to the directions of the Division Bench of this Court in W.P.(MD)No.32371 of 2025, dated 13.11.2025. Meanwhile, the petitioner has filed an appeal / request to change the classification of the land.

Considering the facts and circumstances of the case and the submissions made, this Court is of the view that the petitioner's appeal / request cannot be considered at this stage, since the show cause notice was issued pursuant to the directions of the Division Bench in W.P.(MD)No.32371 of 2025, dated 13.11.2025. As directed by the Division Bench, the proceedings shall continue before the competent authority.
