BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED: 01.12.2025
CORAM:
THE HONOURABLE DR.JUSTICE G. JAYACHANDRAN AND THE HONOURABLE MR.JUSTICE K.K. RAMAKRISHNAN K.Abirami ... Petitioner Vs.
1.The Additional Registrar General, Madurai Bench of Madras High Court, Madurai.
2.The Principal District Judge, Theni, Theni District.
... Respondents PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents herein to re-appoint the petitioner as the Junior Assistant or Typist as per the petitioner's educational and other extracurricular qualification from the date of the petitioner appointment ie., from 07.07.2025 along with all wages by considering the representations dated 22.07.2025 and 06.11.2025 within a stipulated time period in accordance with law. For Petitioner : Mr.C.Senthil Murugan For Respondents : Mr.N.Mohideen Basha (R1) Standing Counsel 1/4
ORDER
(Order of the Court was made by DR.G.JAYACHANDRAN, J.) The petitioner herein, who was appointed on compassionate ground and on temporary basis as Office Assistant on 07.07.2025, has made a representation dated 22.07.2025 stating that she possessed Typist certificate and therefore, she must be appointed as Junior Assistant, since there are 31 posts vacant.
2.It is unfortunate that the petitioner had been wrongly advised to file the writ petition. Her appointment itself is a back door entry on compassionate ground, since her husband died in harness and hence, she cannot claim post which is meant for commensurate her educational qualification. If she feels that she is highly qualified, she has to gain that employment by way of competitive process and not on compassionate appointment. This compassionate appointment is given to tide over the sudden economic breakdown of the family in cases the Government servant dies in harness.

3.The prayer in the writ petition is itself misconceived and deserves to be dismissed in limine. Accordingly, this writ petition stands dismissed. No costs.
