PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to renew/re-issue passport by processing the application No.MDA075669944325 dated 22.09.2025 within a stipulated time period in accordance with law on the basis of the explanation cum representation dated 14.11.2025. 1/5

ORDER

The present writ petition has been filed seeking a mandamus as against the first respondent for reissuance of the passport based upon his application dated 22.09.2025 and the explanation submitted by the petitioner on 14.11.2025.

The learned Government Advocate(crl.side) appearing for the second respondent submits that the petitioner has been implicated in a criminal case in Cr.No.783 of 2016 on the file of the Kenikkarai Police Station, Ramanathapuram. According to him, so far investigation has not been completed and charge sheet has not been laid.

3. This Court in a judgment reported in 2014 8 MLJ 61 has held that mere pendency of FIR would not be a legal impediment for issuance of passport.

4. In view of the above said facts, the first respondent is directed to consider the application of the writ petitioner and pass orders within a period of four weeks from the date of receipt of a copy of this order.

5. With the above said observations, this writ petition stands disposed of. No costs.
