PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Cr.No.206 of 2015 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 191(2), 191(3) and 103 of BNS, in Crime No.206 of 2015, seeks anticipatory bail.
2. The case of the prosecution is that due to previous enmity, the accused persons attached the defacto complainant's mother and the defacto complainant was escaped from them. Hence, the complaint.
3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail 2/5
to the petitioner.
4. The learned Additional Public Prosecutor appearing for the respondent Police submitted that it is a case of jumped bail. He further submitted a non-bailable warrant was against the petitioner. Therefore, he opposed for grant of anticipatory bail to the petitioner.
5. Considering the fact that the petitioner has jumped bail, this Court is not inclined to grant anticipatory bail. The petitioner is directed to surrender before the concerned Sessions Court and file a recall application. On such application, the learned Sessions Judge shall consider the same in accordance with law on merits on the same day.
6. With the above said directions, this Criminal Original Petition is disposed of.
