R.Gomathisankar v. The Assistant Commissioner (St)
G.R.SWAMINATHAN, J.
This writ petition was disposed of by me on 28.11.2025. Since the order suffers from certain obvious errors, the matter has been posted under the caption "for being mentioned".
2.I am satisfied with the submissions made by the learned counsel for the petitioner.
3.Registry is directed to issue a revised order copy by substituting paragraph 2 as follows:
"2.The petitioner suffered an exparte order at the hands of the respondent. The order was passed on 17.06.2025. Appeal period has already expired. The petitioner is permitted to file an appeal within a period of thirty days from the date of receipt of a copy of this order. The same shall be entertained without reference to limitation. Upon the petitioner filing an appeal within the stipulated time, the attachment made on the petitioner's bank account as well as the petitioner's electronic 1/3
cash credit ledger shall stand lifted. The question of making 10% predeposit does not arise because the appeal arises only in respect of penalty."
25.03.2026 MGA Note: Issue order copy on 26.03.2026.
