Prayer : Writ Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Certiorarified Mandamus to call for the records of the proceedings of the second respondent in Ni.AVI(3)/9664381-4/2025 dated 17.04.2025, signed on 25.04.2025, quash the same as illegal, arbitrary and without jurisdiction insofar as the petitioner is concerned and consequently direct the respondents to conduct a detailed field inspection as required under Rule 5 of the Tamil Nadu Highways Rules, 2003 and file a report before this Court. This Writ Petition has been filed seeking issuance of a Writ of Certiorarified Mandamus to call for the records of the proceedings of the second respondent in Ni.A-VI(3)/9664381-4/2025 dated 17.04.2025, signed on 25.04.2025, quash the same as illegal, arbitrary, and without jurisdiction insofar as the petitioner is concerned and consequently direct the respondents to conduct a detailed field inspection as required under Rule 5 of the Tamil Nadu Highways Rules, 2003 and file a report before this Court.

2. The learned counsel for the petitioner would submit that the petitioner's land in Survey No.77/1C, measuring an extent of 53 cents out of 6 acres, was acquired by the Government for the purpose of constructing a Toll Plaza vide a Notification dated 08.02.2019. An award was passed in Award No.13 of 2020 dated 17.08.2020, granting compensation of Rs.4,73,660.95. However, in the subsequent acquisition proceedings, the details of the petitioner's land inadvertently crept into the Notification dated 11.11.2024, pursuant to which the impugned order has been passed for acquisition.
3. The learned Additional Government Pleader appearing for the respondents, on instructions, would submit that steps would be taken to remove the details of the petitioner's land from the subsequent Notification dated 11.11.2024 and the other related proceedings.
4. Recording the above submission, this Writ Petition is disposed of with a direction to the respondents to take appropriate steps for removal of the details of the petitioner's property from the subsequent acquisition proceedings, as undertaken by the learned Additional Government Pleader Page No. 3 of 5
