ORDER

The Criminal Original Petition is filed to quash the FIR in Crime No.535 of 2025 on the file of the first respondent Police, registered for the offences punishable under Sections 126(2), 296(b), 118(1), 308(2) and 351(3) of BNS, 2023.

The gist of the allegation in the impugned FIR is that due to a dispute that arose since the petitioner and the co-accused had ridden the two wheeler in a rash and negligent manner, there was a wordy altercation between the petitioner and the second respondent; that the petitioner and others abused the defacto complainant in filthy language; that the petitioner and others are said to have taken a sum of Rs.10,000/- from the possession of the defacto complainant and thus committed the aforesaid offences.

3. Admittedly, the petitioner and the second respondent have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo, dated 26.11.2025. Though the first accused is not before this Court as a party, the defacto complainant is not willing to pursue the impugned FIR as against the first accused as well. 2/5

4. The petitioner and the second respondent are present before this Court in person. They are identified by Mr.M.Chandiran, Special Sub Inspector of Police, Veeravanallur Police Station, Tirunelveli District. All the parties confirmed the compromise arrived at between them.

In view of the same, considering the nature of the offences and since the dispute is private in nature, this Court is of the view that no useful purpose would be served in keeping the impugned FIR pending investigation. Accordingly, the impugned FIR in Crime No.535 of 2025 dated 27.10.2025 are quashed as against both the accused and the Criminal Original Petition stands allowed. The joint compromise memo, dated 26.11.2025 shall form part of this order. The petitioner shall pay a sum of Rs.5,000/- (Rupees Five Thousand only) as costs to the Mediation and Conciliation Centre attached to this Bench forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry.
