No.107/Kanimam/2024 dated 28.07.2025 in accordance with the provisions of the Tamil Nadu Minor Mineral Concession Rules, 1959 within the period that may be stipulated by this Court. Heard both sides.

2. The writ petitioner was granted license to quarry gravel in the petition-mentioned land. However, his grievance is that he has not been issued with transport permits. That led to the filing of this writ petition.

3. When the matter was taken up for hearing, the learned Special Government Pleader submitted that there is opposition from the local villagers. So long as the quarry license is in operation, it is the duty of the authorities to issue transport permits and it will not be withheld by citing objection from the local villagers.

4. The learned Special Government Pleader states that the application was not made through MIMAS portal. The petitioner undertakes to submit such application. It is further pointed out by the respondents that DGPS survey report has not been submitted. Such survey report shall be submitted shortly. The written objections 2/4

3 W.P.(MD)NO.34447 OF 2025 of the Deputy Director of Geology and Mining, Sivagangai are as follows:- "4. Due to public objections, the writ petitioner has not applied for transport permit in the online MIMAS portal.

5. Further as per General conditions imposed in the lease deed Sl.No.23 & 30, the lessee has not erected Barbed wire fencing along the boundary of the lease area and also not submitted DGPS survey report so far."

Upon the petitioner fulfilling those conditions, transport permit as sought for shall be issued. This writ petition stands allowed accordingly. No costs.
