ORDER

This writ petition is filed challenging the impugned order passed by the 2nd respondent vide his proceedings in Roc. No.6998/2023/A2 dated 01.09.2023 and consequential impugned order passed by the 2nd respondent vide his proceedings in Na.Ka.No.6998/2023/A2 dated 14.11.2025 and seeking consequential direction to the 2nd respondent to reinstate the petitioner in service.

2. When the matter was taken up for hearing, the learned counsel for the petitioner submitted that the pendency of a criminal case cannot be a ground for not revoking the order of suspension. He has also placed reliance on the judgment of the Hon'ble Division Bench of this Court in W.A.No1657 of 2019, dated 31.07.2023. However, on the contrary, the learned Special Government Pleader submitted that, since the petitioner is facing a Vigilance and Anti-Corruption case, he is not entitled to revocation of the order of suspension.

3. In such view of the matter, the petitioner is directed to submit a fresh representation highlighting the judgment of the Hon'ble Division Bench of this Court in W.A. No. 1657 of 2019, dated 31.07.2023, which has also been followed by this Court in W.P.(MD) No. 27972 of 2025, dated 13.10.2025. Upon such representation being made by the petitioner, the second respondent is directed to consider the petitioner's claim and pass appropriate orders on merits and in accordance with law within a period of four weeks thereafter.
