PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st Respondent to re-issue passport to the petitioner considering his application bearing No.MD1075084301125 dated 26.05.2025 for normal period of 10 years.

ORDER

The present writ petition has been filed seeking a mandamus as against the first respondent for reissuance of the passport based upon his application dated 26.05.2025 for a period of 10 years.

2. It is brought to the notice of the Court that two criminal cases are pending as against the writ petitioner. As far as Cr.No.899 of 2021 on the file of Karimedu Police Station, Madurai City, is concerned, it has culminated in filing of the charge sheet in C.C.No.1366 of 2022 on the file of the Judicial Magistrate No.V, Madurai. As far as crime No.301 of 2023 on the file of the second respondent is concerned, so far investigation has not been completed and charge sheet has not been laid.

3. Considering the above said facts, the petitioner is directed to approach the learned Judicial Magistrate No.V, Madurai, seeking the permission of the Court to go abroad. In case, any application is filed, the same shall be disposed of within a period of four weeks. It is for the petitioner to seek the permission of the Court for issuance of the passport for a period of 10 years. Based upon the order of the learned Judicial Magistrate, the first respondent is directed to proceed in accordance with law. No costs.

4. With the above said observations, this writ petition stands disposed of. No costs.
