The above petition has been filed seeking orders to condone the delay of 427 days in filing the appeal, challenging the award dated 25.04.2024 passed in M.C.O.P.No.789 of 2021 on the file of the Motor Accident Claims Tribunal / IV Additional District Judge, Tirunelveli.

2. Despite receipt of notice, the first respondent has not turned up.

3.Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the second respondent.

4. The learned counsel appearing for the first respondent would submit that if the petitioners are waiving interest for those periods, they are having no objections to condone the delay.

5. The learned counsel appearing for the petitioners would fairly concede and made an endorsement to that effect.

6. Considering the above, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to number the appeal, if it is otherwise in order. The petitioners/claimants are not entitled to interest for the delayed period.
