ORDER : The Court made the following order :- This matter was already referred to mediation and conciliation centre attached to this Bench for amicable settlement between the parties.
2. Today it is stated that the matter is settled before mediation and the mediation report also filed before this Court. Based on the settlement agreement, the following settlement is arrived between the parties:
"a. The petitioner and the defacto complainant mutually agree that they are willing to resume cohabitation and live together peacefully as husband and wife and the parties agree that they shall reside in a rented house at Sempatti with effect from 06.02.2026 and the petitioner agreed that on 07.02.2026 the petitioner shall personally to the house of the defacto complainant and take her to said rental house.
b. The disputed jewellery 16 sovereigns (Thali Chain) the possession of the petitioner and said jewellery was gifted by the petitioner to the defacto complainant at time of marriage and the defacto complainant no objection to the said jewellery being with 2/6
petitioner possession.
c. Both parties further agree that they shall live peacefully maintain mutual respect and affection.
d. The defacto complainant states that her jewellery is with herself and that the petitioner is not possession of any of her jewellery."

Recording the above said mediation report and the settlement arrived between the parties, this this Court is inclined to grant anticipatory bail to the petitioner, subject to certain conditions. 4.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.IV, Madurai, within a period of fifteen days from the date on which the order copy is made ready and on further conditions that:

[a]the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity;
[b] the petitioner shall report before the respondent police daily at 10.30 a.m, until further orders;
[c]the petitioner shall not tamper with the evidence or witness either during investigation or trial;
[d]the petitioner shall not abscond either during investigation or trial;
[e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid 4/6
down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];
[f]If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
