O R D E R

This Writ Petition has been filed seeking to direct the respondents 1 to 3 to take appropriate action about the wrong entry and the wrong registration of the documents by the fourth and fifth respondents by way of considering the petitioner's representation dated 10.09.2025.

2.With the consent of both parties, this Writ Petition is taken up for final disposal.

3.Since no adverse orders are going to be passed against the respondents 4 & 5, notice to the respondents 4 & 5 are dispensed with.

4.Learned Counsel for the petitioner would submit that during the land survey by the Revenue Department under the special UDR scheme, a wrong entry was made in the UDR register, whereby the name of one P.Ponnan was wrongly added in the revenue records. Based on the said wrong entry, the said P.Ponnan and his family members executed a sale deed in favour of the private respondents herein. Hence, in order to rectify the same, the petitioner has given a representation to the official respondents on 10.09.2025. Since the said representation is pending consideration, the petitioner has preferred the present Writ Petition. 5.Learned Special Government Pleader appearing for the official respondents would submit that in the present case, the issue pertains to entries in the UDR. The registration of documents is carried out based on the entries in the UDR. Hence, the petitioner cannot find fault with the Sub-Registrar. If at all there is any grievance of fraud or fabrication, it will attract Sections 83 & 3/7

84 of the Registration Act, 1908 and it is open to the petitioner to lodge a complaint before the respondent police or approach the Civil Court for removal of entries in the UDR. Further, the SubRegistrar has no power to remove the entries in the UDR. Hence, he prays for dismissal of this Writ Petition. 6.Heard the learned Counsel on either side.

7.Admittedly, the issue on hand pertains to wrong entries in the UDR. As rightly contended by the learned Special Government Pleader appearing for the official respondents, the right course available to the petitioner is to approach the respondent police, if he finds any commission of criminal offence and the same would attract the provisions of Sections 83 & 84 of the Registration Act and he has to lodge a complaint to the police. Had the offence not come to the knowledge of the petitioner but come to the knowledge of the Sub-Registrar, in that case, the Sub-Registrar concerned would lodge a complaint before the respondent police. While such being the case, based on the representation of the petitioner, the official respondents cannot pass any orders in favour of the petitioner. Therefore, this Court does not find any merit in this Writ Petition.

8.Accordingly, this Writ Petition stands dismissed. There shall be no order as to costs.
