O R D E R

The petitioner, a suspended employee of the Revenue Department has approached this Court, seeking a direction to the respondents to disburse the subsistence allowance payable to her for the suspension period.

2.The case of the petitioner is that she was suspended from service on 18.04.2025 while she was working as a Village Assistant, Revenue Department, Sivagangai, on certain allegations and in view of a criminal case in Crime No.61 of 2025, dated 17.04.2025, which was registered as against her, on the file of the Thiruvegampet Police Station, for the offence punishable under Sections 120B, 420, 465 and 468 IPC. According to the petitioner, she is entitled to receive subsistence allowance under Fundamental Rules 53(1), however, she has not been paid with any subsistence 2/6

allowance so far. Therefore, she has approached this Court by way of this writ petition.

3.By consent of both the parties, this writ petition is taken up for final disposal at the stage of admission itself. 4.Mr.C.Venkatesh Kumar, learned Special Government Pleader, who takes notice for the respondents submits that this petitioner has not submitted a Certificate, as required under Fundamental Rules 53(2) and 53(3) and therefore she has not been paid with subsistence allowance.

5.Considering the rival submissions made, this writ petition is disposed of with the following directions:- i. The petitioner is directed to submit the Certificate as required under Fundamental Rules 53(2) and 53(3), within a period of one week from the date of receipt of a copy of this order. 3/6

ii. On receipt of such Certificate, the Tahsildar, Revenue Department Taluk Office, Sivagangai/the third respondent herein is directed to pay the subsistence allowance due to this petitioner along with arrears within a period of two weeks from thereon.

There shall be no order as to costs.
