PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Cr.No.66 of 2025 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioners/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Section 318(4) of BNS Act, 2023 and Sections 4(1) & 76(1) of Chit Funds Act, 1982, in Crime No.66 of 2025, seek anticipatory bail.

2. The case of the prosecution is that the defacto complainant and her mother invested money in a chit fund alleged to be run by the petitioners under the name "Sarulatha Chit Fund." It is claimed that, during the period 2023-2024, they invested a total sum of Rs.29,00,000/- through cash, GPay, and bank transfers. It is further alleged that the petitioners promised high returns through real estate and photography businesses and also assured the construction and delivery of a house. It is also alleged that several other persons were similarly induced to invest, and that the petitioners failed to return the maturity amounts. Hence, the 2/5

case.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the respondent Police submitted that the offences committed by the accused are similar in nature. Therefore, he opposed the grant of anticipatory bail to the petitioners.

5. The allegation against the petitioners is that they conducted a chit fund, failed to repay the amounts, and misappropriated a sum of Rs.1,75,00,000/- involving more than 18 victims. It is further alleged that an IP petition was filed while concealing the fact that they were running a chit fund. Considering the nature of the offence, this Court is not inclined to grant anticipatory bail to the petitioners. 3/5
